Thank you for visiting our website https://www.laserclinics.ca/. On this page of the website, the term ‘Laser Clinics Canada’ or ‘LCCA’ or ‘us’ or ‘we’ refers to CAN Skin & Laser Limited (trading as Laser Clinics Canada) and its associated entities. The term ‘you’ refers to the user or viewer of our website, or the client as the context requires.

Booking and Purchase Terms & Conditions

Thank you for choosing a Laser Clinics Canada clinic. In these Booking and Purchase Terms and Conditions (the “Booking Terms”), the term “Laser Clinics Canada” refers to CAN Skin and Laser Limited (doing business as Laser Clinics Canada). The terms “us”, “our”, or “we” refer to the Chosen Clinic (as defined in section 1.1 below) and its affiliates. The term “you” refers to the customer of Laser Clinics Canada.

These Booking Terms, and the Website Terms & Conditions found at https://www.laserclinics.ca/terms-and-conditions/ (the “Website Terms”) and the Laser Clinics Canada Privacy Policy found at https://www.laserclinics.ca/privacy-policy/ (the “Privacy Policy”), which are incorporated herein by reference, apply when you make a booking and/or purchase through our website, https://www.laserclinics.ca/ (the “Website”), via telephone, or in-person at a Chosen Clinic.

By making a booking or purchase, you agree to these Terms with your Chosen Clinic. If you disagree with any part of these Booking Terms, please do not make a booking or purchase.

1. Agreement

1.1 Formation of agreement with your Chosen Clinic

(a) These Booking Terms are agreed and entered into by and between you and the Laser Clinics Canada location with which you make a booking or purchase (the “Chosen Clinic”). Details of the Laser Clinics Canada locations are listed here.

(b) You acknowledge and agree that you are making a booking with and/or purchasing a right to receive goods and/or services from your Chosen Clinic only and are not making a booking with and/or purchasing a right to receive goods and/or services from any other Laser Clinics Canada entity, including any other Laser Clinics Canada locations, CAN Skin & Laser Limited or any affiliates or subsidiaries of Laser Clinics Canada (collectively, the “Laser Clinics Group Entities”).

(c) Subject to applicable law, you agree that your sole rights and entitlements are with your Chosen Clinic, and you agree not to take any action against any other Laser Clinics Group Entity in connection with your booking or purchase under these Booking Terms.

1.2 Client consent form

You agree that you will be required to agree to additional terms with your Chosen Clinic before you receive relevant goods and/or services, including, without limitation, a client consent form.

1.3 Additional terms for particular services and promotions

(a) For certain services, campaigns, promotions, or contests, additional terms and conditions may apply. You can find information on these terms and policies in the Current Promotional Terms & Conditions found at https://www.laserclinics.ca/terms-and-conditions/. You acknowledge that by receiving certain services or participating in a campaign, promotion, or contest, you agree to the Current Promotional Terms & Conditions. In case of any inconsistency between the Current Promotional Terms & Conditions and these Booking Terms, the Current Promotional Terms & Conditions will prevail.

1.4 Assignment

(a) Subject to clause 1.4(b), we may assign these Booking Terms, or any right or obligation hereunder, to any other Laser Clinics Group Entity without your consent.

(b) We will only assign these Booking Terms, or any right or obligation hereunder, to a Laser Clinics Canada location within a reasonable distance of your Chosen Clinic, and that is capable of performing the obligations owed to you, or otherwise with your consent (not to be unreasonably withheld or delayed).

(c) You may not assign these Booking Terms or any right or obligation hereunder to any third party.

2. Accounts

2.1 General

To make a booking or purchase through our customer portal on the Website (the “Portal”), you must register for an account (the “Account”). You must not create an Account on behalf of another person. To create an Account, you:

(a) must be at least 18 years of age;

(b) must possess the legal right and requisite capacity to enter into a legally binding agreement with us; and

(c) agree and warrant to use the Website in accordance with these Booking Terms and the Website Terms.

2.2 Collection of personal information

As part of making a booking and/or purchase, you will provide us with personal information, including your full name, date of birth, and contact details (such as your email address and phone number). We collect, use, and disclose personal information provided by you pursuant to the terms of the Privacy Policy.

2.3 Account Security

When you register and activate your Account, you can choose your username and password. Any username and password chosen by or provided to you must be treated as confidential, and you must not disclose it to any other person or entity. You must exercise caution when accessing your account from a public or shared device so that others are not able to view or record your password or other personal information. You agree not to provide any other person with access to the Website or portions thereof using your username or password. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You are responsible for any password misuse or any unauthorized access using your account credentials.

2.4 Cancellation and suspension

(a) You may cancel or suspend your Account at any time by emailing supportoffice@laserclinics.ca. Where you cancel or suspend your Account, you will no longer be entitled to access your Account.

(b) We may restrict, suspend, or terminate your Account or your access to the Portal, including any material (including all text, graphics, logos, audio, and software) made available to you through the Portal (the “Content”) or any feature of the Portal, in our sole discretion at any time and from time to time, for any or no reason.

(c) Without limiting the generality of paragraph (b), we may immediately suspend or cancel your Account or access to the Portal if:

(i) you are, or we reasonably suspect that you are, in breach of:

(x) these Terms; or

(y) any applicable law;

(ii) we reasonably believe that we or any Laser Clinics Group Entity are, or are likely to be, in breach of law or brought into disrepute, as a result of your use of the Portal; or

(iii) we are required to do so in order to comply with an order, instruction, or request of a regulatory authority.

(d)  To the extent that you would like to appeal the suspension or cancellation of your Account or your access to the Portal under sections 2(c)(i) or 2(c)(ii) above, you can email a written appeal to supportoffice@laserclinics.ca within 30 days of the suspension of cancellation. We will endeavour to respond to your written appeal in writing within 30 days of receipt.

3. Accuracy, completeness, and timeliness of information

We use all reasonable attempts to ensure the accuracy and completeness of the information we provide to you; however, the information on the Portal and as otherwise provided to you is provided on an “as is” and “as available” basis and without warranties of any kind, either express or implied. To the maximum extent permissible under law, we disclaim all warranties, representations, and conditions, express or implied, about the Portal or the Content, including, but not limited to, implied warranties and conditions of merchantability, merchantable quality and fitness for a particular purpose, title, non-infringement of proprietary rights, and implied warranties and conditions arising from the course of dealing or course of performance. We do not represent or warrant the completeness, accuracy, correctness, timeliness, or usefulness of any opinions, services, merchandise, or other information provided through the Portal, in the Content, or on the Internet generally. We cannot, and do not, guarantee your satisfaction with your use of the Portal or the Content. In no event will we be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon the information provided through the Portal or in the Content.

To the maximum extent permitted by applicable law, you agree that we, the Laser Clinics Group Entities, and our subsidiaries, affiliates, directors, officers, employees, representatives, suppliers, licensors, and licensees (collectively, the “LCC Parties”) will not be liable to you or anyone else for any damages of any kind arising from your access to and use of the Portal, its goods and services, the Content, or your reliance thereof. You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including, but not limited to, direct, indirect, special, incidental, consequential, or punitive damages.

We may, from time to time and without notice, change or add to the information, products, or services we provide. While we will endeavour to use our best efforts, we do not represent or warrant that the information made available to you will always updated with the latest information. To the extent that we remove any service offering for which you have already pre-booked, you will be able to cancel that booking and receive a full refund for that service.

4. Bookings and purchases

4.1 Bookings (general)

(a) When you make a booking, you will be asked to provide certain information to assist us in finding an appropriate service for you. You must provide accurate and current information to us to ensure we can find the most appropriate booking for you.

(b) Once you have made a booking, while we endeavour to use our best efforts to ensure that we can deliver the booked service at your booked time, we make no representations or warranties that we will be able to deliver the booked service at your booked time.

(c)  If we cannot deliver the booked service at your booked time, we will use best efforts to find an alternative suitable time and, to the extent that we cannot find an alternative suitable time for both you and your Chosen Clinic, we will offer you a full refund.

(d) When you make a booking, you agree to pay in full the cost of those goods and/or services to your Chosen Clinic, including any taxes and charges that may apply.

(e) All bookings placed are subject to confirmation and acceptance by your Chosen Clinic and may be subject to change upon notice to you pursuant to section 4.1(c) above.

4.2 Website bookings

(a) You may book appointments through the Portal. You acknowledge that you will need to select your Chosen Clinic before you can complete your booking.

(b) After making a website booking, you will receive an electronic communication from your Chosen Clinic confirming your booking.

4.3 Telephone bookings

(a) You may make bookings via telephone. We will advise you that your call is being recorded, and by proceeding with the phone call, you consent to the audio recording and for the audio recording to be shared for the purposes of your Chosen Clinic providing goods and/or services to you.

(b) After making a telephone booking, you will receive an electronic communication from your Chosen Clinic confirming your booking.

4.4 Purchases (general)

(a) When you make a purchase of goods and/or services, you will be prompted to pay the relevant cost of those goods and/or services, including any taxes and charges that may apply via the Website or telephone (as applicable). You acknowledge that any treatments are subject to consultation and suitability, and to our Treatment Terms and Conditions found at https://www.laserclinics.ca/terms-and-conditions/.

(b) We may limit the number or type of goods and/or services available for purchase by you in our sole discretion.

4.5 Refunds and cancellations

Subject to applicable law, you agree and acknowledge that if you wish to change your booking, make a cancellation, or amend your purchase, your rights and obligations are set out in the Laser Clinics Canada Cancellation and Refunds Policy found at https://www.laserclinics.ca/cancellations-and-refunds/.

5. Medical disclaimers

5.1 No professional medical or healthcare advice

(a) You agree that the Content is of a general nature and intended to be used for personal, educational, or informational purposes only. The Content does not constitute professional medical or healthcare advice, diagnosis, or recommendation of treatment and is not intended to, nor should it be used to, replace professional medical advice. In no circumstances should any Content be relied upon without independent consideration and confirmation by a qualified medical practitioner.

(b) Subject to applicable law, we make no representations or warranties with respect to any treatment, action, or suitability or application of medication or preparation by any person whether based on the Content or not. In no circumstances will we be liable for any direct, indirect, consequential, special, exemplary, or other damages arising from the same.

(c) Always seek the advice of your doctor or other qualified healthcare provider with any questions you may have regarding a medical condition or treatment before undertaking a treatment regimen. Your use of the Portal does not establish or constitute a patient-physician relationship with us.

6.2 Adverse reaction policy

(a) We take pride in all of our doctors, nurses, and therapists, who are trained to the required standard. In the unlikely event that you experience a side effect, we will require reasonable time and information to investigate your concern.

(b) You agree to provide your full co-operation during this time, which may include (where reasonable) telehealth consultations for assessment and/or review of your circumstances by a manager of the Chosen Clinic, and/or our doctors, nurses, and therapists.

6.3 Suitability of goods

(a) Goods must only be used for their intended purpose and in accordance with the relevant instructions, precautions, and guidelines. You are responsible for ensuring that the goods are suitable for you and seeking appropriate professional medical advice prior to using any goods.

(b) Without limiting the generality of paragraph 6.3(a):

(i) you should always check the ingredients for goods to avoid potential allergic reactions; and

(ii) you acknowledge that not all goods are suitable for all skin tones. If using prescription medications (oral or topical), pregnant, breastfeeding, or suffering from a specific health condition, you should seek advice from an appropriate medical practitioner or therapist before adopting any new goods or regime.

(c) To the maximum extent permissible under law, we disclaim all representation, warranties, and conditions, express or implied, including, but not limited to, implied warranties and conditions of merchantability, merchantable quality and fitness for a particular purpose, title, non-infringement of proprietary rights, and implied warranties and conditions arising from the course of dealing or course of performance, or the suitability, adequacy, or appropriateness of the goods for you.

(d) You agree and acknowledge that the goods should only be used by you and no one else.

7. Intellectual property rights

(a) All content provided or otherwise made available by us through the Portal, including, but not limited to, the Content, is owned, controlled, and/or licensed by or to us and is protected by intellectual property rights and unfair competition laws in Canada.

(b) All trademarks, service marks, trade names, logos, and graphics (the “Marks) used in or on the Portal, including the Content, are registered or common law trademarks owned or licensed by us for use in Canada. You may not use any Marks without our prior written consent.

(c) You may not remove, alter, or reuse in any manner or for any other purpose, any copyright, trademark, or other proprietary notices that have been placed on the Portal. Any authorized use of the Portal may give rise to a claim for damages and/or be a criminal offence. All rights not expressly granted to you by these Booking Terms remain the property of Laser Clinics Canada and/or our licensors and suppliers.

(d) Subject to these Booking Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicesable right and licence to access the Portal, use the services offered through the Portal, and view the Content for personal, non-commercial use.

(e) You may, from time to time, provide us with ideas, know-how, methodologies, comments, or suggestions relating to the Portal and our services and products (the “Feedback”). When you submit your Feedback, you grant us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sub-licensable, and transferable licence and right to use, copy, modify, create derivative works based upon, and otherwise exploit the Feedback for any purpose.

8. Jurisdiction and governing law

These Booking Terms and your use of the Portal are subject to the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising under these Portal Terms shall be resolved exclusively by the courts located in the City of Toronto in the Province of Ontario.

9. Updates

We may (in our sole discretion) modify, update, or replace any or all of these Booking Terms from time to time. Any and all such modifications are effective immediately upon posting and apply to all access to and continued use of the Portal. You agree to periodically review these Booking Terms, as well as the Website Terms, in order to be aware of any such modifications, and your continued use shall be your acceptance of these.

At the consultation, the health professional will consider your needs and is under no requirement or obligation to administer you with any injectables, if it is deemed inappropriate.
• Consultation bookings must be scheduled with one of our clinics by the last date of the Promotion Period (inclusive). All consultation bookings are subject to availability at each clinic. We reserve the right to decline to apply the Inject Promotion to any consultation bookings scheduled after the Promotional Period. There is no limit on the number of treatments that can be pre-purchased however the Pre-pay policy on use and redemption applies. This policy can be viewed on our website.

The treatments must be redeemed at the clinic location where originally purchased.

Prepaid Treatment Policies Terms & Conditions

Prepaid Treatment

If you pre-pay for treatments you will save an amount according to the pre-payment schedule. There is no refund on pre-pays and they are not transferable to other individuals or treatment areas.

Pre-pays for skin treatments have a 12-month expiry date.

Pre-pays for laser hair removal treatments have a 12-month expiration date. When 10+ treatments are bought, the expiration date will be 18 months

All pre-pays affected by COVID-19 will have an additional 6 months to redeem

48 hours notice is required for any pre-paid appointment cancellations. If you cancel a pre-paid appointment within 48 hours or do not attend the appointment, the treatment will be forfeited.

You agree to these terms by purchasing pre-paid treatments.

Treatments may not be completed by the same therapist each time

Age Policy

Our customers must be at least 18 years of age to have any laser or skin treatments.

Clients may purchase the full body laser hair removal package at the prices set out in the marketing materials from time to time. 

The full body laser hair removal package includes all of the laser hair removal areas offered by Laser Clinics Canada, as set out in the marketing materials from time to time. This package does not include laser hair removal areas that are not currently offered by Laser Clinics Canada.

Clients may elect to remove any area from their full body laser hair removal package

Clients must advise the staff at the time of booking and upon arrival at each appointment of the area that has been removed from the package. No reduction in price is available where areas have been removed from the package.

Bookings must be made for all laser hair removal treatments.

Bookings for this package may not be available at all times on all days.

Payment must be made in advance.

The package cannot be used between two or more clients. Photo ID may be requested.

Clients must pay for each treatment at the time of booking. No pre-payments are available, and multiple pre-paid discount prices are not available. 

The terms of our refund policy

Skin Packages

The savings specified for each package are calculated on the normal per treatment price and not pre-paid prices.

Clients may purchase as many skin packages as they like, however, payment must be made upfront in full and the terms of our refund policy apply.

The full amount of the package is payable prior to the commencement of any treatments.

Bookings must be made for each treatment within the package.

Appointments cancelled, missed, or changed without 24 hours notice will be deemed to have been taken and deducted from the client’s package.

Treatments included in each skin package cannot be exchanged for other treatments. However, the Skinstitut products recommended in each skin package can be exchanged for another Skinstitut product of the same full price value.

An LCCA Therapist will advise clients on the recommended time frames for each treatment within the skin package purchased, however, it is the client’s responsibility to ensure they book their treatments in advance so that there are available appointments.

All treatments within the skin package must be redeemed at the clinic the skin package was originally purchased.

All skin packages have a 12-month expiry on the redemption of treatments.

For the abundance of clarity, Laser Clinics Canada is not required to provide you with an injectable treatment under the Inject Promotion if it is not agreed upon by our in-clinic health professional as appropriate for you and your circumstances at the time of consultation and including at the time of administering the relevant injectable (if different). • You must book a consultation prior to any inject treatment and quote the “20% off dermal filler promotion” at the time of the booking to take advantage of the Inject Promotion. At the consultation, the health professional will consider your needs and is under no requirement or obligation to administer you with any injectables, if it is deemed inappropriate.  

• Consultation bookings must be scheduled with one of our clinics by the last date of the Promotion Period (inclusive). All consultation bookings are subject to availability at each clinic. We reserve the right to decline to apply the Inject Promotion to any consultation bookings scheduled after the Promotional Period. It is your responsibility to ensure that you have a booking scheduled within the Promotional Period.  

• Payment must be made in full in clinic following your treatment and the terms of our Cancellations and Refunds policy continue to apply (available on our website). 

• You must inform us of your medical history at the consultation and prior to commencing any inject treatment. You will be asked to fill in and sign a treatment consent form as part of your treatment in clinic. 

• The Inject Promotion reflects the maximum discount offered for the treatment during the Promotional Period, no other promotion will be applicable to this offer.  

• The Inject Promotion is not to be used in conjunction with any other promotion, including but not limited to the 50% off first treatment offer, any vouchers, gift cards or similar and discounts offered by third parties.   

• All bookings made are subject to our standard terms and conditions of sale, treatment terms, Booking and Purchase Terms and Conditions, as well as the Cancellations & Refunds Policy which are available on our website. 
• Subject to relevant consumer laws, we reserve the right to withdraw this Inject Promotion at any time. 

Laser Clinics Canada Price Match Policy

At participating Laser Clinics Canada clinics we will offer to match a competitor’s price for the same treatment provided it is using the same equipment and/or products and carried out by appropriately qualified staff.

The Price Match Policy only applies to competitors that operate in the same shopping centre as the Laser Clinics Canada clinic the client is seeking to price match.

The Price Match Policy applies to all laser hair removal, skin services, and Skinstitut products in-store. The Price Match Policy does not apply to cosmetic injectables or prices offered by any competitors’ on Skinstitut products via an online shopping/retail website.

Clients must provide proof of the competitor’s advertised price which must be current when seeking to price match and Laser Clinics Canada may take further steps to confirm the validity of the price to be matched. Clients may only purchase the same number of treatments as advertised by the competitor using the Price Match Policy, and if no maximum number of treatments is listed the number of treatments able to be purchased is limited to 3 per client.

Clients must mention the Price Match Policy at the time of purchase and or at the time of paying for their treatment or product. The Price Match Policy will not be applied where the products and/or treatments have already been paid for or received.

The Price Match Policy does not apply to offers made by competitors from group buying, discount, or coupon websites. The Price Match Policy will only apply to cosmetic injection treatments if the treatment requested by the client is necessary, indicated, and recommended for the individual client by one of our medical practitioners following a full consultation and physical assessment.

Our Price Match Policy does not apply to our already discounted Full Body Laser Hair Removal treatments.

Laser Clinics Canada Gift Cards

These conditions apply to use of the Laser Clinics Canada Gift Card (gift card), issued by Laser Clinics Canada (LCC).

Purchasing or using the gift card means that you accept these conditions.

LCC may, in its complete discretion, refuse to sell gifts cards to any person at any time for any reason.

If you let another person use your gift card, you must tell them that they will be bound by these conditions. The law of the state in which the gift card is purchased applies to this agreement. By entering into this agreement you unconditionally submit to the jurisdiction of the courts of the state where the gift card is purchased.

The gift card may only be used to purchase goods or services at the LCC clinic from which the gift card was purchased.

Gift cards cannot be redeemed for cash, returned for a refund, have their balances consolidated to a new gift card, or be replaced after expiry and are not legal tender, account cards, credit or debit cards or securities.

Anyone holding the gift card can use its value to make purchases so your gift card should be kept secure. If your gift card is lost or stolen, immediately report this to the LCC clinic from which it was purchased. We may be able to stop gift card value being used, but take no responsibility and are not liable for any loss suffered by you as a result of a lost or stolen gift card.

We may replace a faulty, lost or stolen gift card in our absolute discretion. Any replacement gift card will have the same unused value (at the time of replacement) and expiry date. Gift cards will be void if they are defaced, mutilated, altered or tampered with in any way. We may subject gift cards to verification and security checks in our absolute discretion.

We may cancel any gift card, or the gift card scheme, for any reason at any time without notice. If so, we may either provide a refund or a replacement gift card of equivalent value unless we reasonably suspect fraud in relation to a gift card. The gift card remains the property of LCUK.

GIFT CARDS ARE VALID FOR ONE (1) YEAR FROM DATE OF PURCHASE.

Gifts cards are valid for one year from the Date of Issue. After the gift card has expired, it is no longer valid. All transactions will be declined. Unused value will not be refunded and will become the property of LCC.
